Saudi Arabia: Labor Law Articles 84 and 85
The award is half a month's wage for each of the first five years and a month's wage for each later year, calculated on the last wage. A worker who resigns receives a third of it after 2 to 5 years, two thirds after more than 5 years and less than 10, and all of it after 10 years. When the employer ends the contract, or a fixed-term contract expires, the full award is due; dismissal for misconduct under Article 80 removes it.
UAE: Decree-Law 33 of 2021, Article 51
A full-time foreign employee who completes a year of continuous service receives 21 days' basic salary for each of the first five years and 30 days' for each later year, pro rata for part-years, capped at two years' salary. UAE nationals are covered by the pension system instead. Employers in the voluntary savings scheme pay into a fund instead of this gratuity.
Service here is counted in days and divided by 365.
Frequently asked questions
How is the end-of-service award calculated in Saudi Arabia?
Half a month's wage for each of the first five years and a full month's wage for each year after that, on the last wage, with part-years counted pro rata (Labor Law Article 84). For example 8 years on SAR 10,000 a month: 5 × 5,000 + 3 × 10,000 = SAR 55,000.
What do I get if I resign in Saudi Arabia?
Under Article 85: nothing with less than 2 years of service, one third of the award for 2 to 5 years, two thirds for more than 5 and less than 10 years, and the full award from 10 years. A woman who leaves within 6 months of marriage or 3 months of giving birth, or anyone who leaves for force majeure, keeps the full award (Article 87).
Which wage is used in Saudi Arabia?
The last wage. In practice this is the actual wage: basic salary plus housing and other fixed allowances. If your contract or payslip splits it differently, ask your employer or the Ministry of Human Resources how it is counted.
How is gratuity calculated in the UAE?
For a full-time employee with at least one year of continuous service: 21 days' basic salary for each of the first five years and 30 days' for each year after, with part-years pro rata, up to two years' salary in total (Decree-Law 33 of 2021, Article 51). Allowances are not included and unpaid absence is not counted. Since 2022 resigning no longer reduces UAE gratuity.
How is a day's salary worked out in the UAE?
This calculator uses the monthly basic salary divided by 30, the common practice. The law states the gratuity in days of wage but not the divisor, so an employer or court may calculate slightly differently.
Is this result binding?
No. It is an estimate from the law's general rules. Contracts, deductions, debts to the employer and special cases can change the final amount; the Ministry of Human Resources (Saudi) or MOHRE (UAE) decide disputes.
